If I were to die right now, my genes would be that of a human being, but nothing you could do to me would be murder as I would not be alive.

Actually, it totally does work that way. Since all living things on earth, as far as we know, share a common ancestor, any two creatures will have some overlap in their genetic structures. According to at least one scientific book (which you can find cited here in The Guardian) the proportion is actually more like 50%. But Captain L’s argument still stands – having “human” genetics is hardly a worthwhile determinant for how we should treat something.
