My life consists of clicking and dragging colorful horses around in Adobe Flash and occasionally publishing the results.

I also do animation for Super Smash Ponies when I’m not working on independent projects. The ride never ends.

Delving back into the copyright stuff, the biggest issue with Fighting is Magic was, frankly, EVO. The fact that an independent game infringing on Hasbro’s trademark was able to go toe-to-toe with several much more mainstream fighting games shows immense interest in such a small project. Regardless of where those donations were going, that’s interest that could be very easily commercialized. The problem isn’t whether Fighting is Magic is protected as parody or free use, it’s that it had really started to blur the line between nonprofit and commercialization, even if Mane6 had the best intentions. As much as it pisses me off to see a great project go down this way, Hasbro was acting completely within their bounds; remember, with copyright and trademark law, it’s essentially up to the owners of those rights to determine if someone is breaking the law or not. Some companies are more benevolent than others when it comes to this sort of thing. Nintendo springs to mind. But it’s all up to Hasbro in the end, and they are pretty much allowed to do anything they want.

Flash indeed. A lot of people got into the show because they were already into animation, but I got into animation because I was already into the show, and it’s gone well enough since then. I haven’t been at it very long; really only since July.

On a scale of vain to incredibly vain, how vain would it be for me to mention Super Smash Ponies in this article?

So. Cease and desist. One thing I don’t like is when people try to defend Hasbro’s actions under the guise of “if they don’t defend their trademark, they lose it.” This isn’t true; trademarks are only lost under the conditions of "abandonment, improper licensing or assignment, or genericity.” We all understand the ideas of improper licensing and genericity, and we know that the My Little Pony trademark was not licensed to Mane6 nor has it become a generic name for fighting games or toys for little girls, so the real grey area is abandonment, which many people take to mean failure to enforce. Abandonment is generally dealt with on a case-by-case basis, but generally refers to a trademark falling into disuse by the company that owns it. It has nothing to do with allowing or disallowing another group to use your trademark for, say, a fan-made fighting game.
