This tag its really good, however, non users can see the content when they click it, and most are kids(with their curiosity)

So, instead of showing the image in question, why not display this message "to see this content,you must first create an account"

how it sounds?

First off, the terms of service state that you have to be 13 or older to use the site in the first place. If we take actions to prevent action that isn't illegal beyond that, then we tread the lines of babysitting instead of being administrators. No kid should be using KYM anyway, and anyone who's a teen or older knows that NSFW media lies behind spoilers. I think that's plenty of warning.

I imagine we have a lot of lurkers here who don't want to create an account just to browse NSFW content. It's technically a simple process, but I don't think it's necessary given our terms of service (for children) and common sense (for those above 13.)

We also don't have any proof at all that these lurkers are children.

I disagree. The tag is there to warn users that NSFW content will be shown if they click it. Whether or not they decide to heed that warning is not our responsibility.

Forcing users to make an account to show saucy stuff isn't necessary. Our rules allow only up to softcore NSFW; we don't allow pornography, nudity or similar stuff. If we were a site where there was a constant risk of showing actual pornography behind NSFW spoilers, I would've agreed, but we aren't such a site.

Not to forget adding that requirement would only lower site accessibility. You and I both know not everyone is willing to create an account. If we block guests from viewing NSFW entries or images, we only lose visitors.

Now there's your argument about curious kids. For teenagers (still kids), whether or not they heed the warning is not our responsibility. The content that is allowed behind spoilers isn't 18+ following our site rules, so should be viewable for them.

Then that leaves only the actual small kids, but I've thought of that. Cheezburger's Terms of Service and Use state that you affirm you’re over the age of 13 when visiting the sites within the network. KYM being a part of Cheezburger, I think you can confirm we can use that as a guideline here. So basically, small kids shouldn't even be visiting this site. Our terms are listed, the responsibility is now with the parents and how well they control their kids when they're on the internet.

And as I stated, the responsibility is not ours but theirs (and in case of the very small, the parents). We have our rules and terms listed, we give a heads up beforehand, we put the choice of viewing it in their hands. We're not forcing anyone here. If they choose to view the image, then the consequenses of that action are also theirs.

If you signed a contract without reading it beforhand, would you say it's suddenly not legally binding? I doubt that would hold up in court.

Just because a user doesn't read the Terms of Use doesn't mean they don't apply. And we're not here to be responsible for users who are younger than 13.

Same for site rules: if you violate them, then you're still responsible. Ignorance isn't an excuse in these instances.

It's more of a hassle for the bulk of lurkers who don't want to make an account. As long as the spoilers say "NSFW" then users know not to click the image if they don't want to see NSFW content.

Verbose and RandomMan have a point, there is a reason why they have the terms and conditions, you know. It's because legally, you have been warned, and ticking the box saying that you agree to them is like signing a contract, if you see NSFW content, you legally read the T&D and therefore it legally isn't the site's moderators' or administrators' problems.

Sure, people lie, but legally you said you told the truth. See what I'm getting at here?

But on the other hand, this site doesn't clearly display the Terms of use when you sign up (or at least I don't remember agreeing to any) and it must only be at Cheezburger. However, I'm not sure about this.

You can find that right at the bottom of this page, or any page on the site, for that matter. It is legally binding and connected to the site by being there, even if it is on Cheezburger. After all, it does also say that KYM is a trademark of Cheezburger.

That said, as is most likely pretty obvious, I agree with Verbose and RandomMan. To put things quite simply, I can’t see an argument being made for this idea that isn’t avertible. To put it simply, NSFW content is posted…but it’s marked as NSFW for a reason. Whether or not the potential viewer of this content has an account and is of the legal age to access the site is nugatory. The choice to view the content remains up to them.

Well yes, it does say it at the bottom of every page, but I'm just saying that for some it isn't enough. However you're completely right and as I said, it's there, so it's been legally stated.
