I'd like to make this portion of my motion festive in light of black history month to show you how correlated our treatment really is, and of course concede on some clear differences. After all, not only does history tend to repeat itself, but few ever truely learn from it. It's black history month, and there's a lot to learn from it. I find these deprivations, discriminations, and unequal treatments to have strong correlations to what my black brothers suffered under the racist Democrats after the abolition of slavery, thanks to Republican Abraham Lincoln up until the Brown V. Board of Education decision, which the Democrats also hated. I do find our struggle in this Democratic-stronghold city similar to the black populations struggle in the 1950s Democrat-stronghold city of Montgomery, Alabama. Yes, the same city with Rosa Parks segregated bus incident, the city many referred to as the "Cradle of the Confederacy", it even held the Confederate Headquarters early on in the Civil War.

According to court documents, as a mob gathered on the West side of the U.S. Capitol on Jan. 6, Miller threw an unidentifiable object at the Capitol building. At the time, he was draped in a Confederate flag. Miller then used a section of temporary barriers as a ladder to scale the walls of the west side of the plaza. He also assisted other rioters in scaling the walls and other architectural obstacles. Miller and others then moved to the Lower West Terrace and close to the tunnel area leading into the building. Miller waved his hand, and said multiple times, "Come on," as the mob chanted "Heave! Ho!" and rocked back and forth in pushing towards the tunnel entrance that law enforcement officers were attempting to secure. Multiple times, he put up his fingers and yelled, "one, two, three, push!" From this position, he also threw a few unidentifiable objects towards the Lower West Terrace tunnel. Then, at about 4:55 p.m., and at his closest position to the tunnel, Miller used a fire extinguisher to spray directly into the tunnel where law enforcement was stationed. Miller was arrested on Jan. 25, 2021, in Cooksville, Maryland. He is to be sentenced on May 23, 2022. He faces up to 20 years in prison for obstruction of an official proceeding and up to eight years in prison for assaulting law enforcement. Both charges also carry potential fines. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors. The case is being prosecuted by the U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section. The government would not be seeking a twenty-one month prison sentence in this case absent the defendant's substantial criminal history, resulting 3 Case 1:21-cr-00350-PLF Document 41 Filed 02/07/22 Page 4 of 41 in a Criminal History Category IV. His first felony conviction resulted from an arrest for possession of a controlled substance in 2000 and his probation was revoked twice thereafter. Draft Presentence Report at 1 44. He has felony criminal convictions in Virginia state court for possession of a controlled substance (5/30/2001), robbery (9/20/2001),' and manufacturing a controlled substance and providing for the resale of drugs (two counts, 4/18/2017). Id. at ¶¶ 44, 45, and 48. He also has a prior felony conviction from the U.S. District Court in Greenbelt, Md., for possession of a firearm after having been convicted of a felony offense (4/13/2006). Id. at 1 46. And he has a Virginia state court misdemeanor conviction for unlawful possession of drug paraphernalia (12/6/2007). Id. at ¶47. Significantly, only three of the defendant's six adult convictions resulted in criminal history points, meaning that his criminal history category of IV arguably understates the severity of his criminal history. Id. at 1¶ 44-52. In addition, in 2009 he was sentenced to 24 months' incarceration for a violation of the conditions of supervised release involving two separate incidents involving police contact, an alleged shooting and vehicle stop, and his unexplained possession of $2000 in cash while inside a vehicle containing half a kilogram of cocaine, a firearm, and another $10,000 in cash. Id. at 1 46.

He also has a prior felony conviction from the U.S. District Court in Greenbelt, Md., for possession of a firearm after having been convicted of a felony offense (4/13/2006). Id. at 1 46. And he has a Virginia state court misdemeanor conviction for unlawful possession of drug paraphernalia (12/6/2007). Id. at ¶47. Significantly, only three of the defendant's six adult convictions resulted in criminal history points, meaning that his criminal history category of IV arguably understates the severity of his criminal history. Id. at 1¶ 44-52. In addition, in 2009 he was sentenced to 24 months' incarceration for a violation of the conditions of supervised release involving two separate incidents involving police contact, an alleged shooting and vehicle stop, and his unexplained possession of $2000 in cash while inside a vehicle containing half a kilogram of cocaine, a firearm, and another $10,000 in cash. Id. at 1 46.
