While the most likely reason for the continuances is the ordinary and covid related delays that effect all legal cases, I speculate that Chris is not coopetaing with receiving a psychiatric evaluation because Chris fears the results. I think Chris would rather be incarcerated for years rather than have it be disclosed that he suffers from significant mental illness. In response to other speculation I've seen here and on YouTube, it's my opinion that Chris is absolutely screwed. He's not getting out anytime soon. Assuming that the Court is indeed waiting for a competency evaluation, once that comes in they will actually hold the preliminary hearing and the judge will rule on whether or not Chris is competent to stand trial. I believe that the standard for competency is whether Chris is able to meaningfully assist in his defense. This is different then the standard for not guilty by reason of insanity. If Chris is not competent to stand trial, he will be put into a mental institution until he is competent. If Chris is competent to stand trial, I believe that the trial would be scheduled at that point. Chris will have the option of trial before a judge or jury. My background: I'm a lawyer in a US state other than Virginia. I currently practice civil law, like contracts, employment, civil rights, administrative law, etc... I did work as a law clerk for a few years after law school, where I did work on criminal cases, but that experience was too limited for me to claim any special criminal expertise. Even if I had more criminal experience, criminal procedure is different enough between the various US states that I can't be sure that I fully understand how things work in Virginia cases.
