13 A. Obstruction of an Official Proceeding 14 The evidence detailed above provides, at minimum, a good-faith basis for 15 concluding that President Trump has violated section 18 U.S.C. § 1512(c)(2). The elements of the offense under 1512(c)(2) are: (1) the defendant obstructed, influenced or 16 17 impeded, or attempted to obstruct, influence or impede, (2) an official proceeding of the 18 United States, and (3) that the defendant did so corruptly. Id. (emphasis added). CAN politics (CNN) – Civil lawsuits seeking to hold Donald Trump accountable for the January 6, 2021, insurrection can move forward in court, a federal judge said Friday in a ruling outlining how the former President could conceivably be responsible for inciting the attack on the US Capitol. Trump's statements to his supporters before the riot "is the essence of civil conspiracy," Judge Amit Mehta wrote in a 112-page opinion, because Trump spoke about himself and rallygoers working "towards a common goal" of fighting and walking down Pennsylvania Avenue. "The President's January 6 Rally Speech can reasonably be viewed as a call for collective action," Mehta said.

"The heated rhetoric that got you riled up and brought you to Washington D.C. has not subsided. Disinformation is not only available, it's getting louder and louder every day. You weren't the only person to fall for it or to embrace it, and some have embraced it who don't even believe it. The lie that the election was stolen and illegitimate is still being perpetrated. Indeed, it is being amplified, not only on social media, but on mainstream news outlets, and worse, it's become heresy for a member of the former President's party to say otherwise. So, it needs to be crystal clear that it is not patriotism. It is not standing up for America. It is not 'legitimate political discourse,' and it is not justified to descend on the nation's Capitol at the direction of a disappointed candidate and disrupt the electoral process. Maryland Man Pleads Guilty to Felony Charges For Offenses Committed During Jan. 6 Capitol Breach Defendant Threw Objects, Sprayed Fire Extinguisher, Joined Crowd Pushing Against Law Enforcement WASHINGTON - A Maryland man pleaded guilty today to felony charges related to the breach of the U.S. Capitol on Jan. 6, 2021, which disrupted a joint session of the U.S. Congress that was in the process of ascertaining and counting the electoral votes related to the presidential election. Matthew Ryan Miller, 23, of Cooksville, Maryland, pleaded guilty in the District of Columbia to obstruction of an official proceeding and assaulting, resisting, or impeding officers. According to court documents, as a mob gathered on the West side of the U.S. Capitol on Jan. 6, Miller threw an unidentifiable object at the Capitol building. At the time, he was draped in a Confederate flag. Miller then used a section of temporary barriers as a ladder to scale the walls of the west side of the plaza. He also assisted other rioters in scaling the walls and other architectural obstacles. Miller and others then moved to the Lower West Terrace and close to the tunnel area leading into the building. Miller waved his hand, and said multiple times, "Come on," as the mob chanted "Heave! Ho!" and rocked back and forth in pushing towards the tunnel entrance that law enforcement officers were attempting to secure. Multiple times, he put up his fingers and yelled, "one, two, three, push!" From this position, he also threw a few unidentifiable objects towards the Lower West Terrace tunnel. Then, at about 4:55 p.m., and at his closest position to the tunnel, Miller used a fire extinguisher to spray directly into the tunnel where law enforcement was stationed. Miller was arrested on Jan. 25, 2021, in Cooksville, Maryland. He is to be sentenced on May 23, 2022. He faces up to 20 years in prison for obstruction of an official proceeding and up to eight years in prison for assaulting law enforcement. Both charges also carry potential fines. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors. The case is being prosecuted by the U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney's Office for the Eastern District of Maryland. The case is being investigated by the FBI's Baltimore and Washington Field Offices. Valuable assistance was provided by the U.S. Capitol Police and the Metropolitan Police Department. In the one year since Jan. 6, more than 725 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including over 225 individuals charged with assaulting or impeding law enforcement. The investigation remains ongoing. More than 165 individuals have pleaded guilty to federal charges, including 22 to felony offenses.

The House Select Committee investigating Jan 6 has issued a subpoena for former White House advisor Peter Navarro.

"Mr. Navarro appears to have information directly relevant to the Select Committee's investigation into the causes of the January 6th attack on the Capitol. And he has a Virginia state court misdemeanor conviction for unlawful possession of drug paraphernalia (12/6/2007). Id. at ¶47. Significantly, only three of the defendant's six adult convictions resulted in criminal history points, meaning that his criminal history category of IV arguably understates the severity of his criminal history. Id. at 1¶ 44-52. In addition, in 2009 he was sentenced to 24 months' incarceration for a violation of the conditions of supervised release involving two separate incidents involving police contact, an alleged shooting and vehicle stop, and his unexplained possession of $2000 in cash while inside a vehicle containing half a kilogram of cocaine, a firearm, and another $10,000 in cash. Id. at 1 46.
