"National Healing"

Among the records that Donald Trump's lawyers tried to shield from Jan. 6 investigators are a draft executive order that would have directed the defense secretary to seize voting machines and a document titled "Remarks on National Healing." POLITICO has reviewed both documents. The text of the draft executive order is published here for the first time. It's not clear who wrote either document. But the draft executive order is dated Dec. 16, 2020, and is consistent with proposals that lawyer Sidney Powell made to the then-president. On Dec. 18, 2020, Powell, former Trump national security adviser Michael Flynn, former Trump administration lawyer Emily Newman, and former Overstock.com CEO Patrick Byrne met with Trump in the Oval Office. In that meeting, Powell urged Trump to seize voting machines and to appointher as a special counsel to investigate the election, according to Axios. The order empowers the defense secretary to "seize, collect, retain and analyze all machines, equipment, electronically stored information, and material records required for retention under" a U.S. law that relates to preservation of election records. [...] Additionally, the draft order would have given the defense secretary 60 days to write an assessment of the 2020 election. That suggests it could have been a gambit to keep Trump in power until at least mid-February of 2021. But the draft executive order also cites two classified documents: National Security Presidential Memoranda 13 and 21. The existence of the first of those memoranda is publicly known, but the existence of the second has not been previously reported. NSPM 13 governs the Pentagon's offensive cyber operations. According to a person with knowledge of the memoranda, 21 makes small adjustments to 13, and the two documents are viewed within the executive branch as a pair. On January 19, 2022, the Supreme Court denied former President Trump's "Application for Stay of Mandate and Injunction Pending Review." This means that there is no pending court order that applies to the records that former President Trump identified as privileged and that President Biden instructed the Archivist of the United States to provide to the House Select Committee on the January 6th Attack on the U.S. Capital, as described in the Archivist's letters to former President Trump dated October 13, 2021, October 27, 2021, and November 19, 2021. Accordingly, the National Archives and Records Administration is now in the process of providing these records to the Select Committee.

Rhodes was arrested this morning in Little Elm, Texas, and Vallejo was arrested this morning in Phoenix. In addition to Rhodes and Vallejo, those named in the indictment include nine previously charged defendants: Thomas Caldwell, 67, of Berryville, Virginia; Joseph Hackett, 51, of Sarasota, Florida; Kenneth Harrelson, 41, of Titusville, Florida; Joshua James, 34, of Arab, Alabama; Kelly Meggs, 52, of Dunnellon, Florida; Roberto Minuta, 37, of Prosper, Texas; David Moerschel, 44, of Punta Gorda, Florida; Brian Ulrich, 44, of Guyton, Georgia and Jessica Watkins, 39, of Woodstock, Ohio. Comment about Ashli Babbit

One person in Wednesday's attempted coup, identified as Ashli Babbitt from San Diego, was shot by an unidentified person and died during the melee. Babbitt was reportedly a 14- year veteran of the Air Force and a supporter of the QAnon conspiracy theory that believes President Trump is saving the world from a cabal of cannibalistic pedophiles. You could say a lot of cruel things about this woman, a lot of them justified, but the cruelest thing I can think of is just to state plainly what happened: this woman traveled from sunny ass San Diego to cold ass dreary ass Washington D.C. in the dead of winter, stormed the seat of the government she had taken an oath to defend, only to immediately catch a bullet that would kill her, depriving her of maybe 50 years of joy and happiness and smiles and laughter, all on behalf of a man who, if he ever gave a single thought to her existence, it would be about her fuckability.

MEMORANDUM Defendant is charged with several criminal acts allegedly committed following the "Save America" rally and subsequent breach of the Capitol Building on January 6, 2021. Mr. Thompson intends to subpoena numerous witnesses involved in the planning and execution of the attempt to disrupt the certification of the 2020 presidential election. These witnesses include former President Donald J. Trump and several members of his inner circle, including Donald Trump, Jr., Rudolph Giuliani, Stephen Bannon, Professor John Eastman, Stephen Miller, and Attorneys L. Lin Wood and Sidney Powell. Considering the significant roles these witnesses play in the legal and political communities, and the evasiveness that some have historically shown in the face of court orders, Defendant submits that appointment of the U.S. Marshals Service is necessary in order to effectuate his right to compulsory process and ensure that the same is accomplished expeditiously.
