I don't think there's much of a difference: both were done far in the past and should no longer be relevant.

There's no way Disney was unaware of Gunn's tweets, but overlooked them because nobody cared. But now some hypocritical douche with an ulterior motive decided to dig them up, and NOW it's suddenly a problem.
