He said you can't legislate with executive orders. What he has been using them to do is 1. Roll back trump's executive orders and 2. Establish actual coronavirus action plans and provide funding for fighting it. He has not made any legislative action using executive orders.

Legislative action is stuff congress does like assign budgets to areas of government. The president CAN use executive orders to assign money within the fields that are relevant. So for example, the legislature assigns 10 billion to combat covid, the president can use orders to direct how that money is used for that purpose, which is what he is doing.

He has not contradicted his past statements. Using an executive order to circumvent the legislature would be something like taking money that was assigned to covid and moving it to the military.
