The CCP has changed what it means to be a civilian for their citizens. Everyone is groomed to either be a state actor or face the consequences. Notice how it said "state-owned." The people on that boat may not be Chinese navy, but they're acting under direction of the state, meaning the strict term of "civilian" is blurred, as is the case in any totalitarian government enlisting citizens on behalf of governmental interests.

Xi is using this to get away with more and more bullshit. This fishing debacle is one of many, and they all follow the same pattern – push the envelope as far as you can, and scuttle away as soon as people confront you for it. Using non-combatants to do the dirty work is as genius a tactic as it is repulsive. They're hoping that by refraining from using combatants in pursuit of underhanded state interests, they can morally armbar anyone who tries telling them off or taking action. Turns out, if you push people far enough, they will snap, and you will reap the consequences. People have had enough, and as far as I'm concerned the blood of those fishermen is on Xi's hands, and on the hands of all his cronies.
