The FBI has seized Hillary Clinton's email server

and other storage devices after it was determined they contained highly classified information her staff could not be in possession of.

Breaking news from AP. Stay tuned and discuss:
Will she actually serve prison time?
Is Bernie Sanders the Democrat Presidential nominee?

update:

The FBI is looking into the security of the Clinton email arrangement. There is no evidence she used encryption to shield the emails or her personal server from foreign intelligence services or other prying eyes.

Word that Clinton had relented on giving up possession of the server, which she has previously said she wiped clean, came as Republican Sen. Chuck Grassley of Iowa said two emails that traversed Clinton's personal system were deemed "Top Secret, Sensitive Compartmented Information" – a rating that is among the government's highest classifications.

Grassley said the inspector general of the nation's intelligence community had reported the new details about the higher classification to Congress on Tuesday.

Those two emails were among four that had previously been determined by the inspector general of the intelligence community to have been classified at the time they were sent. The State Department disputes that the emails were classified at that time.

I really don't think they'll be able to spin her way out of this. Even if they sanitized that server against court orders, the FBI has already found seriously classified info on those thumbdrives, enough to immediately seize them from her staff.

A semi-moderate Republican candidate should be able to prance into the White House backwards on their hands if she's really out of it. The serious contenders will start treating this like they're competing for the Presidency rather then the primaries. It will genuinely change the entire election scene.

Because she could be going to jail.

Patraeus was fired, put on two years probation, and fined $100k for sharing nowhere near as classified information with one person. She's sent tens of thousands of unsecured emails from her own unprotected home email server and now we know at least a handful of then contained seriously classified information. She's toast if she can't slime her way out, but it's pretty hard to spin your personal email/server.

Even if it doesn't cause her to be immediately knocked out, how many people do you think are going to vote for her if it is revealed that she lied and tried to cover up the fact that she was sending classified information? Who would trust her to lead the country?

That too.

If she gets indicted for something, it's de facto over for her campaign. I doubt she'll get indicted, though. She's got way too many connections and owed favors.

I thought she already scrubbed the server clean. It's been months. They've had enough time to go buy a new server and hand that one over.

@xTSGx

True enough. I guess all we can hope for is that whoever covered Clinton's trail did a sloppy job, possibly leaving some evidence behind, like the thumbdrives Lisa mentioned. We'll just have to see how this plays out.

{ Much of the classified information in the e-mail conversations originated with the CIA, according to two government officials familiar with the records. Some of the information was deemed to be classified by the National Geospatial-Intelligence Agency’s classification guidelines. The information included references to information related to satellite images and electronic communications, according to the officials. }

How stupid do you have to be to send CIA info over a server you KNOW is not secure and you KNOW China and Russia and North Korea are actively looking for ways in?

Gonna wait until mid-2016 when the FBI announces no wrongdoing from Clinton and everybody realizes that they were swiftboated once again.

Depends on how public this scandal is/becomes.

Hillary Clinton won't face charges until she's well into her 80;s or 90's, then she'll get a triple life sentence for the rest of her 5 years or so in Federal Prison Camp at Pensacola so she can visit her family from friday to sunday in a nice woodlands area, assuming all charges aren't simply dropped.

I do not believe that people as highly publicized and in such positions of power as Hillary Clinton was face the same justice that we commoners do. It's delayed, if at all, and even then, the sentence is only enough to make people satisfied that an outcome was reached, not to actually serve as any punishment nor deterrent.

You're probably right, however I have a question for you: Has any public official gotten the alphabet agencies' attention to this level before?

Yes. Even just a few years ago. David Petreaus got the attention of the FBI for leaking classified information to his mistress. He pled guilty to one charge, and got 2 years probation, no jail time, and a 100,000 dollar fine.

Scooter Libby before him got their attention in his perjury and obstruction of justice antics, and his sentence was committed by the president.

Catalina Vasquez Villalpando pled guilty to 3 counts of tax evasion and obstruction of justice, spent 4 months in prison and the rest of the 2 year sentence or so on probation.

Only one who served hard time was Wade Sanders, and that was Child Porn charges.

Why these people? Because they were all members of the executive branch at one point or another, and all got slaps on the wrist.

The same branch of government Hillary Clinton was in. So yeah, there's a precedent for slaps on the wrist.

Gotcha. Thank you for being somewhat thorough and citing four relevant cases.

I have one sticking point left, though: has anyone in that branch, even Petraeus, leaked this much information through either malice or incompetence?

Petraeus is the most comparable and the information he shared was nowhere near as classified or of this quantity. This is serious and it will take some effort even for a Clinton to avoid persecution.

& also, he pled guilty. She's been refusing to turn over her server for months, deleted files against the courts order, and especially has been insisting not a single shred of classified info went through her server.

Even with a conviction she'll be either acquitted by Obama, or her sentence will be massively reduced to a couple hundred grand and years of probation.

She's not a nobody like snowden. She's a clinton, and a former secratary of state. And in America, that makes you pretty untouchable by law.

Fox news will have a field day with this, it's gonna be Benghazi 2.0

{ Top U.S. intelligence officials are running out of patience with the State Department's reluctance to turn over emails from Hillary Clinton's private email server, which have already been shown to have included top secret communications, Fox News has learned.

The Intelligence Community's Inspector General has requested some 30,000 emails from Clinton's tenure as Secretary of State in order to conduct its own review. Those emails are in possession of the State Department, which has been gradually releasing them to the public.

An intelligence source told Fox News the State Department has pushed back on the government intelligence watchdog's request, and that Director of National Intelligence James Clapper is considering intervening. The source said the inspector general wants to check the controls on the redaction process and ensure that the office can get a handle on all of the potentially sensitive information that was contained in the Clinton emails. }

The media is starting to report that sources are saying the info found in the emails wasn't just highly classified, some of it was the highest level of classified the government designates.

{ Most seriously, the Inspector General assessed that Clinton’s emails included information that was highly classified--yet mislabeled as unclassified. Worse, the information in question should have been classified up to the level of “TOP SECRET//SI//TK//NOFORN,” according to the Inspector General’s report.

TOP SECRET, as the name implies, is the highest official classification level in the U.S. government, defined as information whose unauthorized release “could cause exceptionally grave damage to national security or foreign relations.”

• SI refers to Special Intelligence, meaning it is information derived from intercepted communications, which is the business of the National Security Agency, America’s single biggest source of intelligence. They’re the guys who eavesdrop on phone calls, map who’s calling who, and comb through emails. SI is a subset of what the intelligence community calls Sensitive Compartmented Information or SCI. And these materials always require special handling and protection. They are to be kept in a Sensitive Compartmented Information Facility or SCIF, which is a special hardened room that is safe from both physical and electronic intrusion.

• TK refers to Talent Keyhole, which is an IC caveat indicating that the classified material was obtained via satellite.

• NOFORN, as the name implies, means that the materials can only be shown to Americans, not to foreigners. }

I don't trust Fox, I need links to reliable sources.

lmfao go look at the same report from any of the other alphabet networks, which are all literally the same.

That literally is literally, they're all copy and pasting from AP directly, they say exactly the same thing. That's what the news is today, copy and pasted directly from one of three sources with maybe some additional effort to find things out from personal sources.

edit: you guys also need to accept that Fox News is the #1 news network in the country and has been for a few years now. The opinion shows and hosts that get their videos on here all the time are not the people reporting the actual news, just like every other network.

Battle of the year shaping up.
Justice Department vs. State Department

This one's from The Hill since ya'll are apparently concerned, they do their own reporting.

{ The State Department backed the Clinton campaign’s comments, all but denying the inspector general’s claims that the material should have been highly classified.

“We’re working with the director of national intelligence to resolve whether, in fact, this material is actually classified,” spokesman Mark Toner said on Wednesday. “But in the mean time, we’re taking steps clearly to ensure that the information is protected and stored properly.”

A Justice Department spokesman declined to comment to The Hill. }

Their whole argument is going to be that the top secret information in the emails might not actually be classified at all.

{ “After months of false assurances from Secretary Clinton, we now know that she recklessly maintained a private server containing classified documents, some of which were classified at the highest level,” Rep. Darrell Issa (R-Calif.) said in a statement. “The only remaining question is whether she will be held accountable for her actions.” }

They're gonna go after her. Hillary Clinton is not the only one with high ranking friends in the government. Obama has no reason to help her either, besides not being able to run, there are emails from his personal aides in there that prove he knew she was using an unprotected server, he could throw her under the bus.

We may now cautiously and curiously expect a spectacle to observe imo.

edit of my edit: Change of plans, gonna let this play out until tonight. The FBI has visited a small tech company in Denver that managed tens of thousands of Hillary's emails while she was Secretary of State, and could potentially have backups of emails she deleted. They've been ordered to preserve all emails related to the Clintons.

I was listening to Fox earlier. They're already having a field day. And who can blame them? Everyone's pissed off at this except the people who need to arrest and jail Clinton, it seems.

"So it's treason, then."

The second quote block was The Daily Beast. This is a bit big for anyone to be making things up. I was texting one of my friends yesterday when it broke and we were waiting to see which alphabet network would publish something first. Even Fox waited, most likely for the official statement for Hillary's camp. What liberal media channel wants to be the first one to tell the world Hillary's campaign is over? The smaller conservative outlets are allllllllll over it.

Her official response literally says no classified information was passed through the server, as officials announce they find highly classified information. I hope Putin emails the media some screenshots tbh, can you even imagine?

In my opinion this is a very apt analogy. The US is going to piss away millions of dollars during investigation for a bipartisan report that is going to come to the same conclusion of no wrongdoing that the Benghazi Committee came to late last year.

A part of me cant help but feel like some of this is intentional defaming.

Like this is simply Hillary's very own "Birth certificate" scenario. There's a chance it's all over nothing. And only dragged out because enough people have just decided she's the devil.

But if it does turn out Hillary is guilty, I don't think I'll shed much tears. There's other options for the Dems to consider and I hope they consider them. Hillary is losing support fast and the democrats are better off picking someone else at this stage

There's not really a chance it's over nothing when 4/40 emails selected as a random sample come back filled with classified information and two of those were designated the highest level of classified protection. They're finally releasing the emails in batches for the public in response to a Judicial Watch Freedom of Information Act request (which they sued the State Department to make happen, since they initially refused) and many of them have censored information blacked out because the public can't read it.

{ Among Clinton's exchanges now censored as classified by the State Department was a brief exchange in October 2009 with Jeffrey Feltman, then the top U.S. diplomat for the Middle East. Both Clinton and Feltman's emails about an "Egyptian proposal" for a reconciliation ceremony with Hamas are marked B-1.4, classified for national security reasons, and completely blacked out from the email release. }

Biden is heavily considering at this point, but his kid just died and he says he doesn't know if he's emotionally ready. That's kinda the Dem's problem, they didn't prepare any other options, and the ones people want a look at (Warren) have adamantly declined.

State Dept. Finds 17,855 Missing Hillary Clinton Adviser Emails

Gawker filed a FOIA request two years ago to receive copies of any emails between Hillary's top adviser/Deputy Assistant Secretary of State Philippe Reines and 33 media outlets. The State Department initially said they had no documents responsive to the request, so Gawker sued to produce documents.

Today the State Dept. responded to a court-ordered status report and said they magically uncovered over 80,000 emails and slightly less than 18,000 are responsive to the original request which will be released in groups every month. They did not offer explanation for why they initially denied the request.

This comes as the Justice Department raises the number of Hillary emails found to contain classified information from 4 to 60 to 305 and the company who managed her server says it's extremely likely a backup server exists which they are cooperating with the FBI to locate.

FBI source: “It’s definitely a criminal probe.”
“I’m not sure why they’re not calling it a criminal probe."
“In this case, a security violation would lead to criminal charges."
"Maybe DOJ is trying to protect her campaign.”

Obama laughed at a ridiculous claim. Hilary actively deleted things. Hilary was trying to hide something, Obama was thinking it was a ridiculous claim.

The two scenarios are far different.

She has less and less hope of worming her way out the more serious this becomes.
I really don't think she'll be able to keep her campaign going if it gets much worse.

Hillary's email firm was run from a loft apartment with its servers in the BATHROOM, raising new questions over security of sensitive messages she held

Ex-employee Tera Dadiotis called it 'a mom and pop shop' which was an excellent place to work, but hardly seemed likely to be used to secure state secrets.

"It's so weird, because it's just a small IT company. I know they've expanded quite a bit since I left but I do think it's strange, we only had the three owners and like eight employees. We didn't do any work in other states."

The way in which Clinton came to contract a company described as a 'mom and pop' operation remains unclear. Baffled by how Clinton decided to hire Platte River, ex-employees suggested David DeCamillis, the company's vice-president of sales and marketing might have had a hand in courting her business.

The company's controversial vice president of sales David DeCamillis is said to be a 'big Democrat' supporter who offered his house to Joe Biden for the party's convention held in Denver in 2008. Platte River Networks also worked for Colorado Governor John Hickenlooper – once heavily tipped to be Clinton's 2016 running mate – during his election to be mayor of the city in 2003. }

Incidentally, Fox News reported that 54% of survey respondents believed that Clinton's actions posed a threat to national security. It has to be noted that the sample surveyed was Fox News viewers rather than the general population, meaning that a whole 46% of the radical conservatives viewing Fox News don't believe she posed any threat to national security. This scandal might not be as scandalous as it appears, at last in terms of public opinion.

@lisalombs
So do you have any sources that aren't either tabloids or hideously biased?

It's a Daily Mail exclusive, they're the ones who went out and identified/contacted/interviewed the previous employees. Any other site that picks up on it is only reporting what DM investigated.

PS Fox News is the highest ranked/most viewed news channel in the country (for thirteen straight years now). It has more viewers than there are registered Republicans, so it must be more than "radical conservatives" who are watching.

Afternoon news update:

FBI Optimistic It Can Recover Some Data From Clinton Server

{ The FBI may be able to recover at least some data from Hillary Clinton's private email server even though there was an attempt to wipe it, two sources with direct knowledge of the process told NBC News on Tuesday. }

Clinton pulls plug on testy presser over server questions

{ A visibly aggravated Clinton repeatedly insisted that she had done nothing wrong, and seemed frustrated at questions about the issue.

"I regret that this has become a cause celebre. But that does not change the facts and no matter what anybody tries to say, the facts are stubborn," she said. }

Like the fact that you sent and received classified info over your special snowflake server.

edit: an orange jumpsuit PRAYER HANDS picture from the press conference today, can it get any better?

{ An aide to a Republican member of the Senate Intelligence Committee told DailyMail.com shortly after the press conference that Clinton's claim {that the only way to know if something is classified is if it has a stamp on it} 'is beyond bizarre and entirely nonsensical.'

'She was one of a few dozen people in Obama's administration with the knowledge and experience to decide if something was top secret,' the aide said after a promise of anonymity so he could speak his mind.

'The way you decide if something is classified, when you're the secretary of state, isn't looking for a stamp. It's looking at the contents. This is the worst buck-passing I've seen since Hillary's husband decided there was more than one way to define the word "is".' }

edit edit: either way, to see a stamp or to read the info and decide, doesn't she still have to open the email on her server???

Hillary Clinton Intentionally Originated And Distributed Highly Classified Information

The State Department released 6,000 Hillary emails yesterday, and news agencies have been scouring them. The Federalist has dug up proof of what a few others have said before, but they went through the legal mumbo jumbo to confirm it.

You have to actually read to understand how they're concluding this, so sorry in advance:

{ The original date of classification of Hillary’s e-mails can be discerned by noting the declassification dates noted next to redactions in the e-mails. Under a 2009 executive order signed by President Barack Obama, classified material in most circumstances is to be automatically declassified after 10 years. In some instances, that duration may be extended up to 25 years.

In this July 2010 e-mail, for example, the entirety of Hillary Clinton’s message was redacted prior to its public release under the federal FOIA law. The redactions of the material were provided pursuant to a provision of law protecting national security information. The printed redaction code “1.4(D),” cited next to the redaction and at the top of the document next to the official classification date, pertains to information on “[f]oreign relations or foreign activities of the United States, including confidential sources[.]” At the top of the document, a declassification date of July 1, 2025 is clearly noted:

That declassification date is highly significant because it is precisely 15 years after the date on which the e-mail was sent, rather than the date on which it was marked.

That is because under federal law, information is classified by nature, not by marking. As a result, federal classification authorities deemed that the information was classified the very second it originated, even if it was not marked as such until August 27, 2015. Also worthy of note is the fact that Hillary’s message is the only content in the entire document that is redacted and marked as classified. This means that she was not merely a helpless, passive recipient of classified national security information; she was the originator. And not only did she intentionally originate the classified information, she intentionally disseminated it via an unsecured, unsanctioned private e-mail server. }

Is this the final nail in Hillary's coffin?

she definitely will not be getting into office now. People have been forced out for less. Even if she gets out of jail time and fines her reputation is kinda tarnished. How can we trust this woman to keep national security.

You underestimate establishment Democrats. They literally have no one else but Biden and he's still extremely tentative.

WashPo is now reporting what The Federalist confirmed, as passively as possible.

Other than initially saying it was more convenient for her, all she's said is that she should have used two separate emails and she's sorry.
