The "subject matter" was that the Mania devs were paying tribute to some dead hacker by referencing one of his mods.
It has nothing to do with Nintendo shutting down fan projects based off their IPs while SEGA allows them to exist. The closest thing relating to what you just said was that SEGA merely allowed this semi-popular hack to exist. Even then, it doesn't have anything to do with what we're talking about here.
I too don't like how Nintendo treats fan projects, but c'mon man time and place.
