Not defending the police, but this picture absolutely does not prove your assertion that the handgun was unfired and that all the cartridges are in the magazine. There is a spent cartridge visible in the folds of the seat fabric next to the slide of the handgun and there clearly is a cartridge in the magazine, but because there aren't any holes or indicators in the side, there's no way to know how many cartridges are loaded. Additionally, multiple sources have reported that casings were found nearby and that there was evidence of the handgun being fired.

I'm all for police accountability, but trying to argue a point by spreading your own misinformation does not help matters.

Of course it does, it matters to those trying to sell a specific narrative, if he was white chances are his story would not be shared.
