Conspiracy theorist Alex Jones was arrested and charged with driving while intoxicated yesterday near his hometown of Austin, Texas. The arrest came after his wife called the police on Jones over an argument between the two.

Authorities booked Jones into an Austin jail after midnight early Tuesday morning with bail set at $3,000. Travis County Sheriff’s Office spokeswoman Kristen Dark said that he had a "strong odor of alcohol" and tested .076 and .079 blood alcohol level. The state limit is .08.

According to TIME, Jones' arrest came just after a verbal argument with his wife, which came hours after a physical altercation between Jones and his wife. The arrest affidavit states, "Dispatch advised the disturbance now was only verbal but earlier in the day ‘it was physical.'"

Jones told authorities that he had a bottle of sake at a sushi restaurant, where he dined with his wife earlier Monday evening. The two got into an argument at dinner, and Jones walked three miles home. Jones told deputies that when the argument continued at home, he left the house for another one of his residences when he was picked up by police.

Hours later, Jones took to his website Infowars to refute the charge, showing off his blood alcohol test results of .076 and .079, which are technically below the legal limit.

"There's your takeaway," Jones said. "Alex Jones innocent. Alex Jones was arrested for DWI and was below the legal limit, but when they put it out in the news, it will be the exact opposite. "

However, BAC is not the only factory in arresting and charging someone with a DWI, a class B misdemeanor. CNN writes:

A reading of 0.08 or above is not the only factor in arresting a motorist, according to the Texas Department of Transportation. "A person is also intoxicated if impaired due to alcohol or other drugs regardless of BAC."
