Fortnite streamer Luke "MrDeadMoth" Munday avoided jail time after he allegedly assaulted his pregnant former partner by claiming he acted in "excessive self-defense."

The Australian streamer plead guilty to assaulting his then-partner during a December 2018 stream of the game after she had repeatedly asked him to stop gaming and come to dinner. Ultimately this escalated into an off-camera screaming match between the two in front of one of at least one of their children that ended in him attacking her, her throwing objects at him, and him throwing objects to the ground. (Warning: the video is graphic.)

On Monday, Munday was sentenced to 14-months of community corrections at Picton Local Court. His lawyer Mr. Mercael argued that Munday was a “loving, caring person with no history of domestic violence,” and was acting out of "excessive self-defense." Munday's partner, identified as "Ms. Campbell," has also been charged with common assault after Munday alleged she had physically abused him as well. She allegedly threw a kettle at him before he retaliated by striking her face and pushing her to the ground.

Judge Mark Douglass stated he would have given Munday an extended jail sentence had it not been for "submissions made on his behalf." He also stated, “There’s no need to do great research to find that children who witness domestic violence struggle. It has a real impact on them. The response was not appropriate, unlawful, and violent.”
