I placed an order on a whim on NLS for the Cocolo, Lolinco, and Mouth of Truth. I had at the time completely failed to consider removing the packaging, even though I regulared here. Turns out this was a pretty big mistake. It reached Canada a few days later, where customs picked up the package. The customs officer was suspicious of the package, referring to the package as containing child p--- sex toys, and after a few days mulling over what to do with it, customs shipped the package to Calgary's ICE team (internet child exploitation team). ICE immediately sent it back, saying that they didn't deal with things that weren't internet related. Customs tried to find a department to take it, and eventually sent out a memo saying they intended to release the package unless any department wanted to take it. The RCMP stepped in and took the package. Once they got the package, the RCMP weren't really sure what to do with it, since I imagine it wasn't what they were thinking it was. They weren't sure if the product was actually illegal either. They decided to travel to Calgary (a 3 hour drive from the border) to meet with an ICE officer who would become an expert witness in this case and interview him about the package contents. I had contacted customs and DHL directly on more than one occasion, but they said it was just a standard delay. Shortly thereafter, DHL contacted me to arrange a delivery. This was unbeknownst to me, an undercover RCMP officer. They arranged a delivery using an undercover officer, while I was under surveillance. The package contained an electronic alarm that would alert them when the package was opened, and coated the inside with a thin powder that reacts to UV light to prove I had touched the contents. The warrant did not include seizing or searching electronics since it was a non-digital customs violation. When I received the package, I threw it into my vehicle and went to work with it. I stopped for gas on the way to work, and in the vehicle I opened the package to confirm it's contents. At my work parking lot, I was boxed in by two undercover police vehicles and one police cruiser, and presented with a warrant for my arrest. They handcuffed me, put me into the police cruiser and brought me to the RCMP detachment where I was photographed and questioned. They grilled me on my sexual preferences, tastes in p---, the package, and nearly my entire life story for about two hours. I was in the interview room for a total of 12 hours before I was granted bail. Canada's equivalent of the CBLDF (Comic Book Legal Defense Fund) declined to assist in the case due, due to the sex toy connection, so I was on my own. Our legal research was interesting. Canada's mandatory minimums meant if I lost, I would at absolute minimum have 90 days in prison and be added to the sex offender registry. Legally, the only way to win the case would be to argue that the character on the box did not represent a minor. That's not that easy, but possible. The officer's justification for it being illegal seemed pretty weak. The Japanese text profile on the package makes it sound like she's an adult (it says she's majoring in psychology). So the question becomes, how much does the depiction and intention matter? Turns out that's actually a pretty interesting topic! We found two court cases, both dealing with real p---. I might have the courts wrong here, but in the BC Supreme Court, they heard a case about an image of a real life person that appeared to be a minor. The judge in that case determined that it wasn't enough that a person looked young, he had to be convinced beyond a reasonable doubt that the person was a minor. If the judge in our case held that belief, I think we could win. But, there was also a case heard by the Saskatchewan Court of Appeals, that found the opposite in another real p--- case, that the actual age was irrelevant as long as the "average person" would perceive the person as a minor. You heard that right, actual age was irrelevant. Reminds me of that Australian case... either way, if we faced that kind of burden, we'd be completely screwed... and neither of those cases hold any precedent within Alberta. Possibly concerned that they had a weak case, the prosecution reached out and offered a peace bond in exchange for dropping charges. A peace bond is a court order that holds no admission of guilt, and means you have to abide by the terms of the order for up to 1 year, and if you complete it, it's removed from your record. Of course, it's not really removed, it will still turn up on a vulnerable sector check and customs will probably still see it, but it's not a part of your criminal record. My lawyers negotiated with them to drop the "no internet usage" clause, so I was left with an order to meet with a probation officer regularly, meet with a court appointed psychologist regularly, no contact with minors, and stay away from parks, playgrounds, schools, and swim areas. Though we thought it was possible to win the case, I couldn't risk wrecking my life over this for a chance for vindication (and not much else). Not to mention legal fees would be way more if it went to trial, even if I lost. So I accepted the terms. It's been about half a year since the peace bond ended. All in all, this ordeal cost me $20000 in legal fees, I won't be able to get a job with the government or in any vulnerable sector, and I'm unsure if they'll let me travel to the US (they don't look well on customs violations). It could have been a lot worse though...
