Kris Kashtanova used Midjourney's A.I. model to produce the comic book, Zarya of The Dawn...and became the most publicized test case for whether A.I. image generations should be granted copyright protections for human authorship. She was rightfully rejected. Why? Well, the Copyright attorneys have echoed what I mentioned before, which is ANY prompter's contribution to the A.I. image generation process is purely ART DIRECTION. Therefore, a prompter is NEITHER directly or substantially responsible for the actual authorship of the image itself - just the direction of it. But even so, STILL prompters have less say in the art direction than most Art Directors who work with human artists...because the A.I. generation process is still largely randomized/arbitrary, despite the specificity of the prompter or prompt engineer. Make no mistake, Kris Kashtanova was backed by Midjourney and the A.I. community as a whole, who OBVIOUSLY sent her out with Midjourney's legal counsel to legitimize A.I. 'art' by getting it 'on record' as legal precedent, and indistinguishable from human crafted art.... which is why the entire A.I. community attempted to anthropomorphologize the neural network of the A.I. models as this was playing out. You would need to alter it radically for it to count as a transformative work, to the point where you may as well just do the art yourself from scratch. The thing is, most people trying to jump onto this technology aren't willing to put in that much work. They just want an art machine that can do all the work for them.
