I think the most likely of the third party characters that may get a chance in smash are:
Shovel Knight: The developers of his game are encouraging him to be in smash and has huge fan popularity
Rayman: Has 3 trophies in Smash already.
Phoenix Wright: All the ace attorney games are nintendo exclusive, have great sales, and Phoenix has moveset potential as shown in Ultimate Marvel vs Capcom 3 and if the original Megaman was in Marvel vs Capcom 2 and made it in smash why not Phoenix?
Professor Layton: All the Layton games are nintendo exclusive, the layton games are the best selling DS games, and Layton has moveset potential like his use of the sword
Shantae: Has potential with her genie abilities and hair, nintendo exclusive, and has huge popularity
Banjo-Kazooie: The first 4 games in the series are nintendo exclusive, highly requested, and Microsoft said it would be ok if he was in Smash
