The riddle itself is terrible actually. The issue is that the one telling you the riddle either has to be the one that tells the truth, or they are both liars, because the liar can't tell you the rules without telling the truth. Which means if they are both actually liars, you lose regardless, or the one that told the riddle is always the truthful one.
