I think in fanart to have them qualify as species:saiyan either has to be a canon female saiyan or show the tail cut scar, or better, just have the tail there.

I get that some decisions were made to save on effort but sometimes the effort itself is what's appreciated, half of my enjoyment of SSJ3 comes from how much of a bitch it is to draw and animate it so if you gonna use it you will make it worth the hassle.
